In April 2026, Director of National Intelligence Tulsi Gabbard declassified transcripts and investigative records tied to the August 2019 whistleblower complaint that sparked the first impeachment of President Donald Trump. The complaint alleged that Trump, during a July 25 phone call with Ukrainian President Volodymyr Zelensky, pressured Ukraine to investigate Joe Biden and his son while withholding military aid. Gabbard’s office highlighted procedural changes made by then-Intelligence Community Inspector General Michael Atkinson. Previously, IC whistleblower forms required complainants to provide firsthand knowledge or credible evidence for a complaint to qualify as an “urgent concern.” In the months before the impeachment process, the form language was updated to allow secondhand information—even if deemed unreliable or hearsay—without the stricter firsthand standard.

Declassified documents show Atkinson’s preliminary review involved interviews with only four individuals: the whistleblower (a CIA analyst who had worked on Ukraine policy under Vice President Biden), an associate linked to prior intelligence controversies, and two character references. None had direct knowledge of the Trump-Zelensky call. Atkinson did not obtain the official transcript of the conversation, ignored Department of Justice guidance that the matter did not meet statutory “urgent concern” criteria, and forwarded the complaint to Congress anyway.

Gabbard stated the changes enabled the process to proceed on indirect testimony alone. Her office has issued criminal referrals to the DOJ regarding Atkinson and the whistleblower for potential misconduct.At the time, the ICIG maintained that federal law had never strictly required firsthand information and that the form update merely clarified existing procedures.
